General Terms and Conditions

Terms & Conditions of Entry

The Event is the Ballarat Show 2025 (‘Event’).

This Event is owned and operated by the Ballarat Agricultural and Pastoral Society Inc (‘the Promoter’) of 6 Rose Hill Road Mount Rowant, VIC 3352. ABN: 47 574 429 194.

1. Terms and Conditions are Binding

Tickets to the Event are sold or given, and admission to the Event is granted, on the express condition that you are bound by these Event Terms and Conditions and any other rules and regulations issued by the Promoter (‘Event T&Cs’). By purchasing an Event ticket, you agree to be bound by the Event T&Cs.

2. Directions of Event Staff

You must follow the reasonable directions of Event staff as required and comply with the law at all times during the Event.

4. Event Tickets

Entry to the Event Site will be granted with presentation of a valid ticket issued by an Authorised Ticketing Agency.

6. Ticket Restrictions

Tickets may not be resold or used for advertising, promotion, competitions or commercial purposes without the Promoter’s prior written consent. Breach may result in cancellation without refund.

7. Ticket Purchase Limits

The Promoter reserves the right to enforce ticket purchase limits and cancel any orders that exceed published limits.

8. Search on Entry

As a condition of entry, you and/or your possessions may be searched. Refusal will result in denied entry without refund. Prohibited Items will be confiscated and not returned.

9. Smoking Policy

The Event operates a No Smoking policy, and you must comply with it.

10. Photography & Recording by Attendees

Personal cameras are permitted. Professional equipment (e.g. detachable or telephoto lenses over 20cm) is not permitted without Promoter accreditation. Photos are for personal use only and cannot be sold or displayed publicly. Recording or filming without permission is prohibited.

11. Images and Promotional Use

By entering the Event Site, you consent to being photographed, filmed or recorded by the Promoter and its authorised representatives. These images and recordings may be used, without further notice or compensation, for promotional, advertising, archival and reporting purposes in any media, including social media, websites, and printed publications. The Promoter will use images respectfully. If you wish to request removal of an image in which you are clearly identifiable, you may contact the Promoter, and such requests will be considered in line with privacy and consumer laws.

12. Restricted Capacity

Some venues within the Event may have limited capacity. Admission is not guaranteed once capacity is reached.

13. No Animals

No animals are permitted other than registered service animals.

14. No Passouts

Passouts will not be issued unless otherwise stated.

15. Behavior, Alcohol, Drugs, Signage

You must act in an orderly and respectful manner. Disorderly, offensive or unsafe behaviour may result in refusal of entry or eviction. Only alcohol purchased on site may be consumed within the designated licensed area. Possession or supply of illicit drugs will result in removal and may be referred to police. Unauthorised signage or promotional activity is prohibited.

16. Personal Information & Privacy

The Society collects personal information to manage the Event. Information will be handled in accordance with the Privacy Act 1988 (Cth) and relevant Victorian privacy laws. Unless you opt out, you may be contacted with promotional information about the Promoters events.

17. Promoter’s Liability

Services will be provided with due care and skill in accordance with the Australian Consumer Law. Nothing in these Event T&Cs excludes rights that cannot be excluded by law. Except as required by law, the Promoter and the Event Site owner/lessee will not be liable for any loss, damage or injury sustained at the Event.

18. Indemnity

You agree to indemnify the Promoter and the Event Site owner/lessee against any loss or damage arising from your negligence or breach of these T&Cs.

19. Release & Risk

Entry is at your own risk. There are inherent risks in the participation in or on an amusement ride, device, attraction or the interaction with animals. You, by your participation, accept the inherent risks of which a prudent person is or should be aware of. You should consider this participation an exercise in good judgement and act in a responsible manner while using the facility.

Adults/carers are responsible for persons under their supervision. Persons under 12 years of age must be accompanied by a parent or guardian at all times at the Event.

You must act with good judgement and consideration, both for yourself and others, and refrain from behaviour which could affect your safety, the safety of others, the safety of the amusement ride, device, attraction, or the safety of the animals.

You must obey all reasonable written and verbal instructions and warnings, given by the Promoter and its staff, or appointed contractors, Operators of any amusement ride, device, attraction or animal handlers, without objection.

You must use, as instructed, all safety equipment provided when participating in any amusement ride, device or attraction.

You are responsible for your own personal property. The Promoter is not responsible for any loss or damage to personal property.

The Promoter takes all reasonable steps to provide a safe and enjoyable premises. However, the Promoter will not be liable for any person in respect of the loss of life or personal injury to, any person, whether that loss, damage or personal injury is caused by any person’s negligence (including the negligence of the Promoter) or otherwise.

In these T&C s, the Promoter includes the owner and operator of the Showgrounds, and all employed staff, agents, contractors, consultants or representatives.

20. Enforceability

If any provision of these T&Cs is found unenforceable, the remaining provisions remain valid.

21. Refund & Cancellation Policy

The Event is an all-weather event. Tickets are for the Event, not for specific artists or acts. Changes to the program, date, or venue do not entitle you to a refund except where required by the Australian Consumer Law.

22. Government Directions, Force Majeure & Event Changes

The Promoter may cancel, postpone, relocate, or alter the Event (including its date, venue, program or capacity) where required by government order, public health directive, law, regulation, or in response to circumstances beyond its control (including pandemics, epidemics, extreme weather, or other force majeure events). Where this occurs:

  • Ticket holders will be entitled to a refund, credit, or transfer as required by law;
  • The Promoter will not be liable for additional costs (e.g. travel, accommodation); and
  • Reasonable notice will be given where possible.

23. Environment

Please respect the environment and community. Place litter in bins provided and be mindful of waste and water use.

24. Prohibited Items

The following restricted or prohibited items are not permitted into the Ballarat Showgrounds and Events Centre and are subject to immediate confiscation:

  • Illegal substances, including controlled, dangerous or illicit drugs;
  • Glass or breakable containers, including unsealed bottles and containers;
  • Alcohol;
  • Flares, pyrotechnics, confetti, or ticker tape;
  • Any whistle, loud hailer, public address system or other electronic or broadcast device;
  • Laser Pointers or any object which might be used to distract, hinder or interfere with the conduct of any event or any animal or person taking part in an event;
  • Prohibited weapons or controlled weapons within the meaning of the Control of Weapons Act 1990 (Vic);
  • Knives or other dangerous weapons including potential missiles;
  • Animals, with the exception of accredited guide and accredited assistance animals;
  • Any item that person intends, or another person intends to distribute, hawk, sell, offer or expose for sale or distribution;
  • Any object, device or substance that may be used to deface or damage any part of the Ballarat Showgrounds, such as any spray paint or permanent markers;
  • Skateboards, scooters, roller blades/skates or bicycles;
  • Balloons, kites, rockets and unmanned aerial devices (drones), flags or banners over 1m x 1m;
  • Eskies, chairs, sun shelters and musical instruments;
  • Any other item that in the opinion of the Promoter could cause harm, injury or public nuisance or otherwise compromise the safety and security of other patrons.
